ARTICLE 1 – SCOPE OF APPLICATION

These General Terms and Conditions of Sale apply to the sale of all products (hereinafter "Products") offered on this website (hereinafter "Site"), whose publisher is WellnessHub Deutschland, Tel: +393270707315. Placing an order implies the complete acceptance by the customer of the full terms and conditions of the site, to the exclusion of all other terms and conditions.

ARTICLE 2 – PRODUCTS

All characteristics of each product are recorded by the customer. Photos on the website are not the responsibility of the seller.

ARTICLE 3 – PRICE OFFERS

Promotional offers are only valid as long as they are online and available. The prices indicated on this website are in Euros, including all taxes, excluding shipping costs (see Article 7) and may change throughout the year, provided that the ordered products are paid at the prices during the order.

ARTICLE 4 – THE ORDER

The order is finalized by clicking the "Confirm Shopping Cart" button. By confirming their order and clicking the "Proceed to Checkout" button, the customer declares acceptance of all terms and conditions of sale. The customer's order is subject to an acknowledgment of receipt, in which the details of the order will be sent to the customer's specified email address. This confirmation will list the exact amount and specify the delivery method of the order. The seller reserves the right to cancel any order from a customer with whom there is a payment default or a dispute regarding the payment of a previous order, or for any other legitimate reason, especially due to the unusual nature of the order.

ARTICLE 5 – PRODUCT AVAILABILITY

The range of products on the website is only valid within the limits of available stock. In case of unavailability of the product after placing the order, the seller must inform the customer within 8 days and indicate the waiting time for receiving this product. The customer then has the option to request cancellation of the order (payment by bank transfer to the customer's account will be used for the payment of the order within 15 days) or to exchange their order by email to info@fit-hero.de

ARTICLE 6 – PAYMENT

6.1. Payment Methods

The customer must pay for the order using one of the payment methods offered on the website. Purchases on the website are processed exclusively in Euros. Online payment by credit card is completely secure.

Retention of title: The products remain the property of the seller until the price has been paid in full by the customer. Your personal data and information are necessary to manage your order and maintain our commercial relationship. They may be sent to companies that contribute to these relationships, such as those responsible for the execution of services and orders for management, execution, processing, and payment.

This information and data are also stored for security reasons, to comply with legal and regulatory obligations, to improve the services we offer, and to personalize the information we send you. In accordance with the Data Protection Act of January 6, 1978, you have the right to access, rectify, and object to personal data concerning you.

Simply write to customer service, stating your name, email address, and if possible, your customer reference. In accordance with applicable regulations, your request must be signed and accompanied by a copy of an identity document with your signature and the address to which the reply should be sent. A reply will then be sent to you within two months of receiving the request. Our website is also designed with special attention to the needs of our customers. For this reason, we use cookies. 6.2. Security of Card Payments

Transactions go through Mollie, Stripe, and Paypal websites, and no information about the cards is stored at fit-hero.de.

ARTICLE 7 – DELIVERY

7.1. Delivery Conditions

The products will be delivered to the shipping address entered during the ordering process. It is the customer's responsibility to provide all correct order details for proper delivery. If the customer is not present at the time of delivery of the package by the carrier, they must arrange the new delivery themselves or pick up the package at a designated collection point. Delivery takes an average of 2 working days after payment of the order online and a maximum of within the next six working days. Shipping costs or provision are to be borne by the customer. The delivery date can be extended by a period of seven days at the request of the customer or the seller, and it will be the date for the delivery of the ordered product, except in cases of force majeure asserted by the seller. After this period, the customer can contact the seller by email, stating their decision to cancel the order, in which the full amount paid must be refunded within 30 days.

7.2. Exchange or Refund Conditions

In case of non-conformity of the received product with the ordered product or damage due to transport conditions noted by the customer on the day of receipt of the package, the seller will exchange or refund the product. The customer must inform the seller by email and indicate whether they wish to exchange the product or receive a refund by filling out the complaint form available on the website.

Provided that the delivered product is returned in its original packaging and in perfect condition to the address communicated to the customer by email, an exchange or refund will be made within 30 days of receipt. The product will be exchanged for a strictly identical product from stock, or, if the product is no longer available, for a comparable product. If the customer wishes, the returned product will be refunded by the seller, including shipping costs, once the seller's liability is established.

ARTICLE 8 – RIGHT OF WITHDRAWAL

The consumer has a period of fourteen days to exercise their right of withdrawal without giving reasons or penalties, except for the costs of return, if applicable. In the event that the consumer can move simultaneously and where they need immediate services and essential living conditions, the consumer can waive this period. In this case, they would still exercise their right of withdrawal without giving reasons or penalties. The period mentioned in the previous paragraph begins with the receipt of the goods or the acceptance of the service offer. If the information provided is not provided, the period for exercising the right of withdrawal is extended to three months. If the provision of such information occurs within three months of receipt of the goods or acceptance of the offer, the fourteen-day period mentioned in the first paragraph begins. If the seven-day period expires on a Saturday, Sunday, or a public holiday, it is extended to the next working day.

ARTICLE 9 – WARRANTY AND RESPONSIBILITY

The customer has the legal guarantee against hidden defects. The seller cannot be held responsible for the non-performance of the contract in the event of a defect (temporary or permanent) unavailability of the product, or in cases of force majeure, malfunction or total or partial strike of postal services and transport and/or communication services. The seller is not liable for damages resulting therefrom; loss of business, loss of profit, loss of opportunities, damages or costs.

ARTICLE 10 – IT AND FREEDOM

The data entered by the customer when ordering is processed by the computer and is necessary for the creation of the contract. The customer has the right to object to access and modify the data that the seller, but also the service providers he would use, would have. To exercise this right, the customer must send his request to info@fit-hero.de

ARTICLE 11 – AMENDMENT OF THE GENERAL TERMS AND CONDITIONS

Given the possible evolution of the site, the seller reserves the right to modify or amend these terms and conditions at any time. The new terms and conditions of sale will be communicated to the customer by online modification accordingly and will only apply to orders placed after the modification.
